  BET-AT-HOME ORDERED TO REPAY €950,000 TO LOSING ROULETTE PLAYER

  An Austrian court has ordered online gambling operator Bet-at-Home to repay an unlucky gambler a sum of €950,000 after he has lost it on roulette. The court argued that since Bet-at-Home has no valid Austrian license, players are allowed to request a refund on their losses.

  Case process is as follows:

  1.Operator Bet-at-Home will have to repay €950,000 to a player who lost on roulette

  2.Austrian court says that Bet-at-Home's European license is invalid in the country

  3.The player in question was playing with stolen money

  Online gambling operator Bet-at-Home has been ordered by an Austrian court to refund a player with a sum of almost €1 million after the player in question has lost this money playing roulette at the online casino branch of the company.

  Bet-at-Home does not have a valid online casino license in Austria but so far it managed to provide its services to Austrians without any problems. The reason why Austrian law and the mentioned court ruling applies to Bet-at-Home is that the company has an office and subsidiary in the country.

  The case has first been submitted to the lower court where it was rejected. After this, the player in question has submitted an appeal to the Higher Regional Court which this week ruled in his favor. As a consequence, Bet-at-Home will have to repay the €950,000 the player has lost on roulette.

  The judge presiding over the case has commented the following:

  "The defendant and its subsidiary companies would in fact have required a concession in accordance with the Austrian Federal Law on Games of Chance in order to offer an internet-based roulette game."

  He further explained that:

  "Since the game was offered without an appropriate Austrian concession, the contracts between the defendant and the plaintiff were inadmissible and not legally binding. The plaintiff is therefore entitled to a full refund on his lost stakes."

  This could set a serious precedent in Austria that could result in players registered at unlicensed online casinos to request a refund on all their losses. The major issue regarding this situation is that due to the country's gambling monopoly, operators have an extremely hard time in acquiring a license in the country.

  Bet-at-Home, for example, tried to convince the European Court of Justice last year that the operator's Maltese online gambling license is in accordance with the laws and player protection measures of Austria. The court however, ruled in the favor of Austria and rejected the operator's claims.

  The player in question turns out to be a thief

  To spice the case up even more, it was also revealed that the player in question has stolen the money from the company where he was working. Having access to financial data of the company, the player has stolen a sum of €1 million that he lost on roulette at Bet-at-Home.

  Still, this aspect did little to help Bet-at-Home. The operator is now forced to return the money lost by the player, unless it successfully appeals to the Austrian Supreme Court. The player, on the other hand, will in the meantime be tried for the theft of the €1 million.
